SA to USA - Com - IF

HI Guys,

wondering if anyone could help with some info. (Sorry if its been discussed and i missed it)

A friend of mine has a SA CAA Commercial Pilot license with current instrument rating, he is going over to USA to take collection of a new Jet he bought and once he has completed his type rating he would like to fly around the USA for a while before sending his plane back to SA.

So the question is: What is involved in Converting his South African Commercial license to an American Commercial or Instrument Rating?

He doesn't really need to do a FAA Commercial License as he will not be flying for money but rather pleasure but its almost impossible to fly a Jet without an instrument rating.

Does anyone know whats involved in doing this?

Hi

I think the easiest will be to gain the FAA PPL based on a foreign license, with IF privileges based on your foreign IF rating. (FAA will issue a PPL regardless of holding a CPL or ATP)
Then write the foreign IF exam it's 50 questions as opposed to 60 for the default exam.

If the current SA license is current including the IF rating then no check ride is required for the IF, it's a matter of making an appointment and visiting a FDSO (local FAA office) with passed written exam, photo ID and FAA completed applications forms as required and applying for a temporary airman certificate based on foreign (PPL with IF privileges.)

This is a process as FAA have to verify your foreign license with CAA and one should allow about 1-3 months.

The commercial and ATP is another matter here the written exam and check ride will need to be completed.

Another route is to write the stand-alone PPL/CPL and then IF but because it's initial license an M1 Visa and TSA approval will be required.

Call or contact the FAA for the latest information, as some subtle changes happen from time to time.

So, in a nutshell, apply based on foreign
Fill the FAA forms and submit
Write the foreign IF exam 50 questions
When FAA notify you visit FDSO office with your written IF results to get the temp PPL certificate with IF

Or
Select a flight school
obtain M1 Visa and TSA approvals (via flight school)
Complete the stand-alone PPL/CPL/IF written and check rides (Or add CPL and IF stand alone based to your FAA PPL from foreign licenses)

IMHO if time permits best to do the stand alone as a good base will be understood on the FAA system and one gains the stand-alone certificates no longer dependant on a foreign dated license. But if it's a once off thing the validation is the least hassle.

§ 61.75 Private pilot certificate issued on the basis of a foreign pilot license.
(a)General. A person who holds a foreign pilot license at the private pilot level or higher that was issued by a contracting State to the Convention on International Civil Aviation may apply for and be issued a U.S. private pilot certificate with the appropriate ratings if the foreign pilot license meets the requirements of this section.
(b)Certificate issued. A U.S. private pilot certificate issued under this section must specify the person's foreign license number and country of issuance. A person who holds a foreign pilot license issued by a contracting State to the Convention on International Civil Aviation may be issued a U.S. private pilot certificate based on the foreign pilot license without any further showing of proficiency, provided the applicant:
(1) Meets the requirements of this section;
(2) Holds a foreign pilot license, at the private pilot license level or higher, that does not contain a limitation stating that the applicant has not met all of the standards of ICAO for that license;
(3) Does not hold a U.S. pilot certificate other than a U.S. student pilot certificate;
(4) Holds a medical certificate issued under part 67 of this chapter or a medical license issued by the country that issued the person's foreign pilot license; and
(5) Is able to read, speak, write, and understand the English language. If the applicant is unable to meet one of these requirements due to medical reasons, then the Administrator may place such operating limitations on that applicant's pilot certificate as are necessary for the safe operation of the aircraft.
(c)Aircraft ratings issued.Aircraft ratings listed on a person's foreign pilot license, in addition to any issued after testing under the provisions of this part, may be placed on that person's U.S. pilot certificate for private pilot privileges only.

(d)Instrument ratings issued. A person who holds an instrument rating on the foreign pilot license issued by a contracting State to the Convention on International Civil Aviation may be issued an instrument rating on a U.S. pilot certificate provided:
(1) The person's foreign pilot license authorizes instrument privileges;
(2) Within 24 months preceding the month in which the person applies for the instrument rating, the person passes the appropriate knowledge test; and
(3) The person is able to read, speak, write, and understand the English language. If the applicant is unable to meet one of these requirements due to medical reasons, then the Administrator may place such operating limitations on that applicant's pilot certificate as are necessary for the safe operation of the aircraft.

I agree that this the easiest way but two things to look out for would be waiting for a verification letter from the SACAA which can take a while. Second the FAA license is valid for the ratings on the SACAA license and if he goes to the states for the rating he must just double check that will be allowed to fly the plane before the paperwork is processed by the SACAA.

Since he is going to do the type rating there he already have a flight school and will have to do TSA clearance so he might as well just do the FAA cpl as part of the type rating. This is only an idea he must check with the flight school to see if it possible.

If I bought a jet (or basically anything above $1m), I'd do my damn best to keep it an N-reg and fly it on an FAA Com. Even if based in SA. Would be interested in the thought process for your friend - but it's a bit of thread drift.

By the way, if you go for getting an FAA Com you're going to have to wait for SACAA to produce the validation anyway. It is needed by the examiner to verify you have an appropriate qualifying foreign license (ie, PPL).
FAA ASEL COM (IF), 360hrs TT, MCSA SAR member, flies out of FACT, KBLM (Monmouth Exec, NJ - USA).
