Portfolio committee squashes amnesty
Says no to Firearms Control Amendment Bill.

Parliament’s police portfolio committee (PPC) has put a proposed firearms amnesty on hold, leaving more than 1 million firearms still without “valid” licences.

The committee yesterday referred to a pending court case, brought by Gun Owners South Africa, as a reason for not considering the amnesty. It says before the courts have made a decision on the matter, an amnesty would be without merit.

"As we stand right now, there will not be a firearms amnesty, it is dead,” says Paul Oxley, GOSA chairperson. “This amnesty was never aimed at taking away the guns of criminals, as criminals don't hand firearms over during an amnesty. This amnesty was aimed at taking away guns with expired white licenses, SAPS made that very clear.”

"The solution to this problem would be to repair the IT system's front-end which was unlawfully tampered with so that it can capture late renewals.” Says Larry Marks counsel for GOSA. "It is gazetted in the regulations, they make allowances for renewal of expired licenses in the firearms license renewal form, published in the government gazette this is known as the SAP518a"

The committee noted that at the last firearms amnesty, around 32 000 firearms were handed in. Of these, not a single one had been used to commit any crime. This supports GOSA's view that criminals do not make use of amnesty periods to hand over their guns.

A firearms amnesty would be a dangerous move. SAPS has let us down before, they have sold amnesty guns to gangsters and, according to research, these have had a direct impact on the increase of crime, including murder, in the Western Cape.

Committee chairperson, Tina Joemat-Petterson, brought up the possibility of holding another firearms summit, with fair participation from all stakeholders, to give Parliament a better feel for the real situation relating to firearms in South Africa.

GOSA welcomes this move, and we thank Ms Joemat-Petterson as well as the Police Portfolio Committee for their interest and dedication to firearms legislation.

Draft amendments to the Firearms Control Act were also not considered yesterday and, again, the pending GOSA court case was cited as a reason why the amendments would not be acceptable.

I heard that amnesty was given to gun owners who did not renew their licences in time, to hand in their weapons by the 31st of March 2020 (IIRC? but could be a later date) without fear of prosecution.

Is that correct? :?

Whirly.
It seems its a trap for legal (expired) gum owners to lose their guns. Cele has no plans for the illegal one's :twisted:

Amnesty has been granted for 6 months and gazetted.

But some newspapers reports that CFR’s IT system has not been functional for weeks so no licenses can be processed...

Ek het lankal my mind opgemaak... tronk is nie n plek waar ek wil wees nie... so my wapens is absoluut wettig.. =D>

Bad reporting again. The system is working for new applications to be approved.

The problem is that the SAPS sabotaged their system to not accept renewals that are done later than the 90 days in the CFR. I.E. you cannot hand in a application if the license expires say in 89 days from the date you want to renew. It must be valid for 90 days. This formed the basis for the successful interim order Judge Prinsloo granted.

The CFR makes provision for late renewals yet the SAPS refuses to accept them, the interim order instructed the SAPS to repair the system to accept late renewals, this has not been done and now the SAPS is trying to appeal the interim order even though they were late in filing for the appeal.

Whirly.
Not correct, the amnesty does not mention expired licenses at all. You can hand in your firearm and MUST within 14 days submit a application (read NEW LICENSE APPLICATION, NOT RENEWAL) for the FA. Keep in mind that the FA will be surrendered to the state and if your application is unsuccessful the FA will be destroyed.

The interim order by Judge Prinsloo protects all FA with expired white licenses until the main application is finalized.

I guess if the SAPS filed late for the appeal then it is not valid?

The system is utterly slow. I applied for a new firearm under section 16 in January 2019. The license was refused in July 2019 and I am still awaiting my appeal to be finalized... almost a year and still no license...
