Yep, the law is one thing and evidence another - like a lot of rape claims it becomes a "he said, she said" situation. Now if the kid ends up in hospital or the neighbours see something, ect, then you would have the necessary corroboration. Without that the claimant is on a hiding to nothing :lol:

Agreed. There's the theoretical situation and then the practical. In any event even a diary could conceivably be the product of a fertile imagination, so wouldn't probably constitute corroborative evidence.

In any event, I suspect that the de minimus rule would ensure the NPA will not bother itself with a simple smack or two.

Yeah - robbing a child of their childhood seems a barbarically cruel thing to do. I knew a few kids like that in school - just had their entire enthusiasm for life beaten out of them. Broken in a way that is hard to fix.

....never in the Bible is it penned that abuse or assault is prescribed for discipline to a child or person - the "rod" refered to is a metaphor for the (manner of discipline required)* as each and every child / person is different.

...* this may vary from incarceration to a pep talk and everything inbetween - depending on the person.

That was my recollection too.

Its a dangerous road we walk when quoting religion in terms of the law... one should not forget we are not a purely Christian society and application of one religion is not in our constitution either... we are required to respect all religions and application of one section of one religion is walking a thin line... not sure that those quoting the bible in this instance would be happy to subject their children to the application of a section of another religion when they grow up. Suggest that using the bible as a convenience in this instance is rather disengenuous... its amazing how many Christians have come out of the woodwork in the spanking of their children context :!: :roll:
