US Blacklists the Guptas

Hopefully this isn't against the T's and C's, if so please remove.
Seems the Guptas fowls are starting to roost.

Today, the US Department of the Treasury’s Office of Foreign AssetsControl (OFAC) sanctioned members of a significant corruption network in South Africa that leveraged overpayments on government contracts, bribery, and other corrupt acts to fund political contributions and influence government actions.

Specifically, OFAC designated Ajay Gupta, Atul Gupta, Rajesh Gupta, and Salim Essa for their involvement in corruption in South Africa pursuant to Executive Order (E.O.) 13818, which builds upon and implements the Global Magnitsky Human Rights Accountability Act.

Actually he shouldn't have been surprised because as I under it that is exactly what happened. It appears it was his doing as Minister of Justice and Correctional Services. As posted in the Myeni thread:

I am open to correction but this was on request from the SA govt. They have reached out to 8 countries asking for "mutual legal assistance" in re the Guptas and Essa.

So the Gupta's havent technically been found guilty or have they? If NOT surely they cant be blacklisted :?:

Elephant in the room...

If there is enough evidence to blacklist them and its legally correct then... it takes two to corrupt, the one who received the money and the one who paid it... what of the ones who paid it or are we hanging the poor Gupta's out to dry here :?: :wink:

It’s all about trading in dollars. If you are corrupt in SA ront then life is good..

Edit: sorry, should have said ONLY corrupt in SA ront.

You're talking about a specific USA Act where if certain requirements are met you can be subject to certain sanctions as regards your assets there which will be frozen until the issue is resolved one way or the other. Nothing hit or miss about it.

This is similar to the R50 million of Gumede et al assets that the NPA unit have seized and will hold pending the outcome of the cases against Gumede et al. If they get off then the assets will be returned.

In both cases (USA and SA) the folk concerned don't have to be found guilty for this to happen. The assets are held pending the outcome of the relevant cases where those people are charged with certain offences. SOP.
