Correct. The law states that there must be an insurable interest. That's why key-man insurance works. If the insured person shuffles off this mortal coil it could cost money to replace him or her.

EDIT 1: people, assets and third party insurance are all different concepts with different legal rules applying, don't confuse one with 'tuther.
EDIT 2: if there is no insurable interest then it is "gambling".

Caveat: I am not an expert on Insurance Law so the above is AIUI.
I get it, but at the end of the day the club knew he was going across and had a signed deal, they should have had insurance in place. End of story. The fact he was on (probably) an illegal flight is not the clubs fault, unless they organized it. Insurance should have covered this event, I would have thought

Any club which does deals of this value would be foolish to not be insured.
I would question why they would not want to pay the previous club, it's not like their policy would pay out if they believe he hadn't transferred, unless of course they either don't have cover or insurance intends to repudiate the claim.
For all we know there are caveats in the policy, much like there are in conventional life policies that do not cover aviation by default.
if they have found themselves in a spot of bother it would be worthwhile to fight for a settlement, given the money at stake.

It's also very possible that the player was insured and the insurance company has taken charge of the situation and are checking that all the i's were dotted and the t's were crossed before they authorise payouts.

Really? A PPL, on a commercial flight, at night, single engine, over water. These are not assumptions. I'd say that's pretty dirty.

I see that the AAIB prelim report says that in the last 15 minutes, Mr Ibbotson descended sharply four times telling air traffic control he was struggling with visibility and around 15 seconds before the fatal crash he plunged at a rate of 7,000ft (2133m) per minute - equivalent to around 90mph (144km).

Shades of JFK junior's graveyard spiral, methinks.
